1. Ownership

www.transportesresende.com is an internet domain owned by Transportes Resende, S.A. (hereinafter referred to as the Resende Group), with its registered office at Rua Conde S. Salvador, 492 4450-264 Matosinhos, Portugal, registered with the Porto Commercial Registry Office under company number PT501070699. Unless otherwise stated, references on this website to the Resende Group should be understood as references to Transportes Resende, S.A. and its subsidiaries and affiliates.

2. Object

This Legal Notice regulates the use of this domain. Use of this portal implies acceptance of the conditions contained in this Legal Notice and that you are a “User”.

Grupo Resende reserves the right to unilaterally modify or update, at any time and without prior notice, the content, configuration and presentation of the portal, as well as the “Terms and Conditions of Access and Use” and the “Confidentiality and Data Protection Policy”.

The use of certain services offered on the portal will be cumulatively regulated by the particular rules and conditions that, in each case, are deemed to be in force and applicable at any given time, which are deemed to be accepted when using said services.

3. Terms and Conditions of Access and Use

4.1. Dados Pessoais

The Resende Group declares its respect for and compliance with the provisions of Law no. 67/98, of October 26 (Portugal), which regulates the protection of individuals with regard to the processing of personal data and the free movement of such data.

Grupo Resende, in accordance with current legislation, hereby informs you that the personal data provided by the User through the use of the portal or by registering on it, will be stored in an automated personal data file, which it owns.

When necessary, Grupo Resende will ask the User to fill in the Data Update form, which will be made available for this purpose on the portal.

Grupo Resende also undertakes not to share or provide the information collected to third parties, unless expressly authorized to do so.

Access to personal data will be restricted to authorized persons.

The Resende Group maintains data protection security levels in accordance with current legislation on security measures for automated files containing personal data, and establishes all the technical means at its disposal to guarantee the privacy of the data that the User entrusts to the Resende Group and to prevent its loss, misuse and unauthorized alteration and access, without prejudice to alerting the User to the fact that security measures on the Internet are not impregnable.

Users have the right to access their personal data and to review it, as well as to demand that it be corrected, altered, updated and deleted or blocked. They also have the right to withdraw their consent, at any time and free of charge, by emailing geral@gruporesende.pt.

The User hereby expressly consents to the collection and processing by Grupo Resende of his/her personal data obtained through the use of the portal or through his/her registration on it.

4.2. Dados Não Pessoais

Any non-personal information, communications and material that the User sends to the portal or to Grupo Resende by e-mail will be considered non-confidential data. Grupo Resende is free to use and reproduce this information freely and for any purpose. Specifically, Grupo Resende will be free to use the ideas, concepts, know-how ortechniques contained in this information for any purpose, including the development, manufacture or marketing of products. All the information that the User sends to the portal must be true, must not violate the rights of third parties and must be legal.

5. Cookies

Grupo Resende uses “cookies” technology, through which its servers deposit special codes on the User’s computer. This information helps to determine the total number of visitors to the portal on an ongoing basis and the types of Internet browsers and operating systems used by Users. 8. Intellectual and Industrial Property Rights Associated with the Portal

By accessing the portal, the User is granted a limited license to use said portal. This license grants the User a limited, non-exclusive right to use the content of the portal for his/her private use only.

The portal is a work protected by Copyright and Related Rights and by Industrial Property Rights. The portal and each of the elements that make it up (such as brands, logos, photographs, images, illustrations, texts, video clips, etc.) are the exclusive property of Grupo Resende, the only entity authorized to use Intellectual Property Rights and associated personality rights, which does not grant any license or any right to the User other than to consult the portal. Any reproduction or representation, in whole or in part, of the portal or any of the elements that make it up, on any medium whatsoever, and in any form whatsoever, for other purposes, particularly commercial purposes, is expressly prohibited.

9. Limitation of Liability and Exclusion of Warranties

The User acknowledges and accepts that the use of the portal is his/her sole and exclusive responsibility.

Grupo Resende does not, in general, control the use that Users make of the portal and, in particular, does not guarantee that Users use the portal in accordance with the law, these terms of use, morals and good customs commonly accepted in public order, nor that they do so in a diligent and prudent manner.

The portal and all materials offered on it are intended for general consumer information purposes only. Neither the portal nor any materials are intended to constitute (and do not constitute) the giving of advice or the provision of content, data, software, information, products and/or services. Any mentions of professionals or the information (including, but not limited to, its contents and results) contained in or provided through the portal are for general information purposes only and do not imply that Resende Group has any association with such professionals.

Although Grupo Resende makes every effort to ensure the uninterrupted availability of the portal, it shall not be liable if for any reason it is not available at any time during a given period.

Grupo Resende also does not guarantee the absence of errors in the content, that it is up to date, or the absence of viruses or other harmful elements on the portal or on the server that provides it.

Grupo Resende is not responsible for any damage that may be caused by the faulty operation of the external domain portals to which links have been established.

10. Resolution

Without prejudice to any liability for damages that may result, Grupo Resende may, immediately and without prior notice, terminate its relationship with the User, interrupting their access to the portal or to the corresponding services, if it detects a use of the same or of any of the services linked to it that is contrary to the applicable conditions.

11. Changes

The Resende Group may, at any time and without prior notice, change the presentation and configuration of the portal, as well as these conditions or, where appropriate, introduce new conditions of use by publishing them on the portal, so that they can be known by the User when they access it and before proceeding to use it. The use of the Portal, once the applicable changes have been made, will signify the User’s acceptance of said modified conditions.

12. Communications

The User accepts that the Resende Group may send him/her communications or contact him/her by e-mail, post or any other means provided by the User.

The User may make any other queries or comments by sending a postal communication to the Resende Group’s registered address or by e-mail to geral@gruporesende.pt.

Users who have given their consent to the sending of communications under the above terms may, at any time, exercise their right to object and refuse to be sent future communications, under the terms described in the previous section “Confidentiality and Data Protection Policy”. In this case, communications between the Resende Group and the User will be carried out in accordance with the contact details provided, and the User expressly accepts the use of email as a valid means of exchanging communications.

13. Nullity and voidability

In the event that any provision of this “Legal Notice” is deemed null and void or unenforceable, in whole or in part, by a judicial or administrative decision issued by the competent authority, such nullity or annulment shall not affect the validity of the remaining provisions of these terms, except when the party claiming its nullity or annulment proves that without the clause that will be null and void or invalid the objectives sought by this “Legal Notice” could not be fulfilled.

14. Applicable Law and Jurisdiction

This “Legal Notice” and the relations established between the Resende Group and the User are governed by Portuguese law. For all questions arising from the interpretation and application of this “Legal Notice”, as well as to settle all questions and disputes that may arise, the User of the portal accepts the jurisdiction of the courts of the headquarters of Transportes Resende, S.A.
